Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Clixly app ("Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 13 years old to use Clixly. By using the Service, you represent that you meet this requirement. If you are between 13 and 18, you confirm you have parental consent.

3. Account Registration

You may register using Google Sign-In or as a demo user. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. Notify us immediately at support@clixly.app if you suspect unauthorised access.

4. Acceptable Use

You agree not to:

• Upload or process content that is illegal, abusive, defamatory, obscene, or infringes third-party rights
• Attempt to reverse-engineer, scrape, or circumvent usage limits
• Use the Service for commercial AI training or dataset generation
• Impersonate other persons or entities
• Violate any applicable laws or regulations

5. AI-Generated Content & Third-Party AI Services

Clixly uses third-party AI services to power its features:

• Google Gemini API — used to apply photo effects. Photos are sent to Google's servers for processing and are not retained after the effect is generated.
• FAL.ai — used for the AI Avatar feature. When you create an AI avatar, your selfie photos are sent to FAL.ai to train a personal portrait model. By using the AI Avatar feature, you consent to this processing as described in our Privacy Policy.

You retain ownership of your original photos. AI-processed output is provided "as is". We do not guarantee specific results. You grant us a limited licence to process your photos solely to provide the Service.

6. Subscriptions & Billing

Paid plans (Basic, Pro, Commercial) are billed monthly through your App Store or Google Play account via RevenueCat.

• Subscriptions renew automatically unless cancelled at least 24 hours before the renewal date
• Manage or cancel subscriptions through your device's subscription settings
• Refunds are handled by Apple / Google under their respective policies
• Prices are in USD and may vary by region

7. Creator Fund & Referrals

The Creator Fund pays eligible creators based on effect views and engagement metrics as published in the app. We reserve the right to modify Creator Fund terms, eligibility criteria, and payment rates at any time. Referral rewards are granted at our discretion and may be subject to minimum thresholds.

8. Intellectual Property

The Clixly name, logo, and all app content (excluding user-uploaded content) are owned by us or our licensors. You may not reproduce, distribute, or create derivative works without our express written consent.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time from the Profile screen. Upon termination, your right to use the Service ceases immediately.

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.

13. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance. We will notify you of material changes via in-app notification.
